1. general provisions

2. offer and conclusion of contract

Offers, information, details, prices and product statements (e.g. on the website) of the provider are subject to change and non-binding. They shall only become legally binding upon written confirmation. Declarations of acceptance and all orders require written or telex confirmation by the supplier to be legally effective. The Customer’s order without prior offer by the Company is a binding offer. The Provider may accept this offer at its discretion within two weeks by sending an order confirmation to the Customer within this period. The duration, route, details and characteristics of the travel tours or services in the “Language Services” section and other information and details in brochures, leaflets and the homepage are only binding if this has been expressly agreed in writing; otherwise they are only approximate values and do not constitute an assurance or guarantee.

3. fees and prices

The prices stated upon conclusion of the contract shall apply. These are calculated in particular by the hourly rate offered or agreed x the number of hours or time units worked. Any additional ancillary costs (preparation, travel, departure, follow-up, minutes and documentation) are listed in the offer. Additional costs for the customer (e.g. public transport tickets for guided tours) are not part of the offer and must be settled separately by the customer with the respective transport company. The prices quoted to customers and interested parties are exclusive of VAT, unless otherwise stated in the offer.

4. change and cancelation of orders (cancellation) and cancellation fee

The customer can cancel the booked, confirmed services free of charge with a notice period of 7 days before the service is provided. In the event of cancellation up to 24 hours before the start of the service, 50% of the total costs offered will be charged. Cancellations made at shorter notice will be charged in full. For arrivals of more than 60 minutes, the start of the arrival counts as the start of the service. For bookings lasting several days, a maximum of 3 full days will be charged.

5. waiting time

Tours for groups start punctually at the specified time. Guests arriving late are requested to inform us at least 15 minutes before the start of the tour if they can foresee that they will be late. It may be possible to wait a short time. If not, the tour price cannot be refunded. For private tours, the service time to be charged begins at the time of the agreed start of the tour. Here, too, it is helpful if guests who arrive late contact us briefly by telephone.

6. group size

The availability of the tours depends on the size of the group. In the interests of quality, we refrain from conducting large public tours. The size of privately booked tours can be decided by the customer.

7. entering buildings

During the tours, some buildings are entered (churches, public buildings and, if possible, non-public buildings). The provider is not responsible for any additional precautions taken by customers during their stay in the buildings. With regard to emergency exits, rescue equipment, etc., the generally posted instructions should be observed. In case of doubt, the tour guide should be contacted with any questions.

8. fares for transportation or local public transport (OePNV)

Transport costs (privately organized or by public transport) are not included in the tour price and are generally not included in the offer. Any references in the offer to the expected costs are only intended as an indication, but are not part of the tour price. The provider can recommend a suitable public transport ticket for the time and situation in question. However, the provider does not guarantee that the recommended option is the cheapest choice in monetary terms. However, due to the later articulated organization of the day, a recommendation for a day ticket, for example, may make more sense overall. Furthermore, the provider is not responsible for the respective conditions of validity of public transport tickets, which may vary. The Provider cannot make any offers for private transportation (e.g. bus transfers for groups), but can only recommend offers from cooperation partners based on experience. Under no circumstances does the provider act as a transportation intermediary. It merely establishes the contact.

9. entrance fees

Any entrance fees for sights (entrance fees, elevators, attractions) are not included in the tour price. Tickets must be purchased independently on site. This does not apply if it was explicitly mentioned in the offer and the order confirmation. However, the provider can provide an indication of the expected amount of the entrance fee on request.

10. sound and image recordings during the tours

Image, sound and film recordings of the tour, the tour route or the tour leaders are strictly prohibited and are permitted on request.

11. limitation of liability

In the event of slightly negligent breaches of duty, the provider’s liability shall be limited to the foreseeable, direct average damage typical for the type of contract. This also applies to slightly negligent breaches of duty by the legal representatives or vicarious agents of the provider. The Provider shall not be liable to companies for slightly negligent breaches of insignificant contractual obligations.

12. terms of payment / due date

As the end consumer, the customer pays for the tour in advance by bank transfer or directly in cash when the service is provided. Payments by the customer are due within 30 days of the invoice date, unless a different payment term is specified on the invoice. They shall be deemed to have been effected upon irrevocable crediting to an account of the Provider. In the event of late payment, interest on arrears at the statutory rate shall be due without further notice. All charges and fees shall be borne by the customer, unless otherwise offered or agreed. The Provider is entitled to withhold performance if the Customer is in arrears with other payment obligations. The benefit shall only become due once these arrears have been settled in full. Otherwise, in the event of payment arrears or suspension of payment/over-indebtedness as well as non-compliance with payment terms, other claims shall become due immediately. The Provider may demand an advance payment on the expected receivables at its reasonable discretion.

13. data protection / confidentiality

The storage of customer-related data by the entrepreneur is consented to. Reference is made to § 33 BDSG. Unless otherwise agreed in writing, the data disclosed to the Company during order processing shall not be deemed confidential. Such data may be used by the company in compliance with data protection regulations and copyright law. The Company shall not be responsible for the loss of data unless the storage or other backup was expressly made the subject of the order in writing.

14 Copyright

I reserve ownership, copyright and other rights to offers, tour suggestions, tours carried out, texts written as part of translations, etc. They may not be reproduced, used or made accessible to third parties without their express written consent.

15. severability clause

The invalidity of one or parts of a business condition shall not affect the validity of the remaining conditions and the contract concluded. In the event of invalidity, a provision that comes as close as possible to the intended agreement shall be agreed. Henstedt-Ulzburg, April 01, 2015
